In a statement released on Thursday, October 20, officials from Santa Fe County confirmed Halyna’s untimely death, which occurred just before 2:00 p.m. PST.

“Detectives are investigating how and what sort of projectile was used,” the department stated. “Investigators think the sequence being filmed involved the usage of a prop firearm when it was discharged.”

According to the summary of the postmortem examination into Hutchins’ death, which was legally signed by New Mexico’s chief medical investigator, “law enforcement reports showed no conclusive evidence that the weapon was loaded with live ammunition on purpose.”

Baldwin has denied pulling the trigger and told investigators that the assistant director told him it was a ‘cold gun,’ indicating that it did not contain live ammunition.

Santa Fe County Sheriff Adan Mendoza headed the original investigation into Hutchins’ murder and found “a degree of negligence” on the film set.

However, after presenting the results of a year-long investigation in October, he deferred to prosecutors for potential criminal charges. The report does not specify how live ammunition arrived at the crime scene.

Is Alec Baldwin Under Arrest? Charges Considered

In the fatal shooting of camerawoman Halyna Hutchins, the armourer who monitored all weapons used in the production of the Western film “Rust” and actor Alec Baldwin will be charged with two counts of involuntary manslaughter.

By the end of January, formal charges will be filed in the First Judicial District Court of New Mexico. Each defendant will be required to make their initial court appearance.

According to the office of the district attorney, Baldwin and Gutierrez-Reed will be charged alternatively. In other words, a jury would determine not only whether the defendants were guilty, but also under what definition of involuntary manslaughter they were guilty.

David Halls, the assistant director, has also agreed to a plea bargain for negligent use of a deadly weapon. The plea agreement stipulates a six-month probation period and a suspended sentence.

The second charge is negligent homicide while performing a legal act. This charge requires proof of greater than usual negligence resulting in a fatality.

The maximum sentence for this second violation is 18 months in jail and a $5,000 fine. This felony carries a firearm enhancement, which mandates a mandatory additional term due to the involvement of a firearm. The addition carries a mandatory prison term of five years.

In 2019, the American Society of Cinematographers (ASC) named Hutchins as a Rising Star, she informed American Cinematographer magazine.

She was an exceptional lady. She was capable of withstanding any level of stress. She was an outstanding collaborator and ally to anyone who appeared before her camera.

Journalist-turned-filmmaker Hutchins was born in the Ukraine as an army brat. According to her website, she “grew up on a Soviet military post in the Arctic Circle surrounded by reindeer and nuclear submarines.”

She told American Cinematographer that she was already a movie buff because there wasn’t much to do outside.
