Immigration authorities deported the pair and took them to Arlington, Virginia, where they were arraigned on charges of breaking the terms of their short-term visas.

After Konanykhin claimed that Russian prosecutor Volvodez was masterminding his deportation for political purposes, Judge John M. Bryant ordered a series of hearings between July 19 and August 2, 1996, to establish whether or not his life and freedom were in danger. The trial dealt with questions about whether the Russian secret police had taken over the banking industry and whether the United States government had been duped into going after Konanykhin by the Russians.

In a settlement agreement negotiated in Arlington, Virginia on August 26, 1997, between Konanykhin, who had been held in the INS custody for more than 13 months, and the District Director of the Arlington INS District Office, District Judge T.S. Ellis III, signed off on the arrangement. Judge Ellis described the testimony of Yuri Shvets and Antoinette Rizzi in Konanykhin’s immigration case as “credible and somewhat alarming” in a statement. ordered the INS to pay Arent Fox Kintner Plotkin & Kahn, the firm that represented Konanykhin pro gratis, $100,000 in legal fees. In addition, as part of the agreement, Assistant U.S. Attorney Robert Spencer was required to confirm, within 30 days, that the Department of Justice will investigate the performance of INS lawyers at the hearing.

When Konanykhin and Gratcheva were granted political refuge by Judge Bryant on February 23, 1999, he stated that returning the former banker to face embezzlement accusations would put him in danger of persecution and even death. After hearing testimony from a number of specialists, Bryant came to the conclusion that Konanykhin was being prosecuted for political purposes.

At this time, the FBI formed a Moscow section; as a result of the FBI’s desire to build a relationship with Russian law enforcement, they decided to support Volvodez in his request for Konanykhin’s removal. A minor visa violation was enough for the Justice Department to agree to deport him because Russia and the United States do not have an extradition agreement. In 1999, Konanykhin’s first asylum application was rejected because of the fraudulent allegation.
